Personal Information Protection Policy

Landau Ford Lincoln Sales Limited


Effective January 1st, 2004 all Canadians are provided with a right of privacy with respect to their personal information that is collected, used or disclosed by an organization in the private sector in an era in which technology increasingly facilitates the collection and free flow of information (quoted from the Canadian Department of Justice).
Landau Ford Lincoln Sales Limited fully supports this act and its 10 privacy principles as follows:1. Accountability:  An organization is responsible for personal information under its control and shall designate an individual or individuals who are accountable for the organization’s compliance with the following principles.Norma Weber (Controller) is appointed as the person accountable for Landau’s compliance with the act’s principles.  In the event that Ms. Weber is unavailable, Robert Friesen (Vice-President) will act on her behalf  2. Identifying Purposes:  The purposes for which personal information is collected shall be identified by the organization at or before the time the information is collected.- personal information that is collected through these means (bill of sale, finance/lease contracts, credit applications - in person or through Ford or Landau web sites, service, parts, body shop invoices and services) is provided to Ford Motor Company of Canada, Limited and Landau itself, and its lending institutions so that information can be provided to the customer regarding administering the transaction (including financing/leasing), services available such as warranty, extended service plans, customer notification programs, to improve automotive related products, conducting customer surveys by either telephone or mail, communicating marketing material such as offers, updates and information which may be of interest to the customer  3. Consent:  The knowledge and consent of the individual are required for the collection, use or disclosure of personal information, except when inappropriate.- there are three types of consent – a) opt in consent when the customer acknowledges by his/her signature that they give Landau permission to use their information as outlined in this policy as well as attachments A and B.  This consent once granted is then entered electronically in the customer’s file in the dealership computer system, b) opt out consent is when the customer does not want us to use their information and requests same and c) implied consent is obtained when the customer requests us (Landau) or agrees for us to contact them with either further information or as follow-up to their request for information or as follow-up to their vehicle demonstration drive- individual consent is gathered by Landau by the following means – signature providing consent when vehicle is brought in for either service or auto body repair (or attachment B) and on the sales agreement (or attachment A).  Consent is also provided when customers do not choose the opt out consent option included in certain (service maintenance letters) mailings received by them from Landau. Once consent is received an electronic confirmation in the dealership customer computer file is placed indicating that consent has already been provided by signature or by not exercising the opt out consent  4. Limiting Collection:  The collection of personal information shall be limited to that which is necessary for the purposes identified by the organization.  Information shall be collected by fair and lawful means.- see point number 2 for Landau’s means of collecting customer information  5. Limiting Use, Disclosure, and Retention:  Personal information shall not be disclosed for purposes other than those for what it was collected, except with the consent of the individual or as required by the law.  Personal information shall be retained only as long as necessary for the fulfillment of those purposes.  6. Accuracy:  Personal information shall be as accurate, complete, and up-to-date as is necessary for the purposes for which it is to be used.  7. Safeguards:  Personal information shall be protected by security safeguards appropriate to the sensitivity of the information.- the dealer (Landau) will ensure that all personal documents and related information are stored in a safe and secure manner.  Stored electronic information can only be accessed by authorized employees of Landau Ford Lincoln Sales Limited  8. Openness:  An organization shall make readily available to individuals specific information about its policies and practices relating to the management of personal information.- Landau’s Personal Information Protection Policy is available to any individual requesting it and can also be viewed on the dealership web site (www.landau.ca9. Individual Access:  Upon request, an individual shall be informed of the existence, use and disclosure of his or her personal information and shall be given access to that information.  An individual shall be able to challenge the accuracy and completeness of the information and have it amended as appropriate.  10. Challenging Compliance:  An individual shall be able to address a challenge concerning compliance with the above principles to the designated individual or individuals for the organizations compliance.-  any concerns or complaints should be brought to the attention of Ms. Norma Weber (or designate).  Please call 1.204.480.6870 or email to info@landau.ca.
 
- if an individual has an unresolved concern regarding Landau’s compliance with the Personal Information Protection and Electronic Documents Act and it’s related ten principles they have a right to complain to the federal Privacy Commissioner.  The Commissioner will have general powers to receive and investigate complaints, and to attempt resolution
 Important Personal Privacy Information for Sales Agreements, Service/Parts/Body Shop Invoices and Customer Mail Out Letter Inserts The following are examples of what appears on our bill of sale and service and body shop invoices (either on the actual document or as an attachment).  These require signed acknowledgment at least once.   Sales Agreement (Attachment A):The personal information collected on this form and on other documents relating to this transaction is collected in accordance with the applicable privacy legislation and it’s governed by Landau Ford Lincoln Sales Limited’s Privacy Policy.  Most of the personal information which we collect, use or disclose is necessary for us to sell or lease you your vehicle, to provide products and services related to the vehicle, assist you with in the financing or lease of your vehicle or to provide service to your vehicle and we cannot do this without that personal information.  We may also use or disclose your personal information to provide you with updates and information regarding products and services that we have to offer and which we think may be of interest to you.  You acknowledge and consent to the collection, use and disclosure of this personal information in accordance with that Privacy Policy, for all purposes relating to this sales transaction, and as set out in this paragraph.  If you do not want us to use or disclose your personal information in a particular way, please contact Ms. Norma Weber at 1.204.480.6870 or by email at info@landau.ca .  This is also described in our Privacy Policy.  We also provide this personal information to Ford Motor Company of Canada, Limited (together with third parties acting on its behalf “Ford”) to enable Ford to administer your transaction, to provide you with services such as warranty, extended service plans, and customer notification programs, to improve automotive related products and services by conducting customer surveys, and to communicate with you by providing you with marketing material such as offers, updates and information which may be of interest to you.  To obtain the Ford Privacy Policy or if you do want to receive marketing or survey material from Ford, please call 1.800.565 FORD (3673).Service/Parts/Body Shop Documents and Invoices (Attachment B):Privacy – Personal information is collected in accordance with applicable privacy legislation and is governed by Landau Ford Lincoln Sales Limited’s Privacy Policy.  Your privacy is important to us.  Ask us if you would like information about our Privacy Policy.  We provide this personal information to Ford Motor Company of Canada, Limited (together with third parties acting on its behalf “Ford”) to enable Ford to administer your transaction, to provide you with services, to improve automotive related products and services by conducting customer surveys, and to provide you with marketing material which may be of interest to you.  To obtain the Ford Privacy Policy or if you do not want to receive marketing or survey material from Ford, please call 1.800.565.FORD (3673).  Customer Mail Out Letter Insert Offering Opt Out Consent PIPEDA – Personal Information Protection Electronic Document ActWe want you to know that Landau Ford Lincoln Sales Limited is compliant with the Personal Information Protection Document Act.  Landau has developed a Personal Information Protection Policy that respects and ensures your rights under this act are maintained.Your personal information and privacy is very important to us.  We respect your right of privacy and will only use your information with your permission.  It is important to us to keep you informed about your vehicle maintenance requirements, provide customer sales and service follow-up as well as provide you with information on marketing/service that may be of interest and relevant to you.  If you do not want to receive these services please contact Ms. Heather Fraser, Personal Information Privacy Policy Officer for Landau Ford Lincoln Sales Limited at 1.204.480.6870 or by email to info@landau.ca .  If you choose not to contact us we will assume that you are providing consent.  Thank you for your cooperation and for your patronage.

The personal information collected on this form is collected in accordance with the applicable privacy legislation and it’s governed by Landau Ford Lincoln Sales Limited’s Privacy Policy.  The information we collect allows us to provide you with information on products and services that we think may be of interest to you.  It also allows us to ensure that you have a valid driver’s license and if there is any traffic fines/accidents related to the time you are in possession of our vehicle we have the right to receive payment in full for same from you.  You acknowledge and consent to the collection, use and disclosure of this personal information in accordance with our (Landau) Privacy Policy.
